Data Privacy & Cybersecurity

The privacy and protection of personal information and the security of data is of critical importance in today’s advanced technological society. With no one law clearly defining the restrictions on the collection of data across jurisdictions, this otherwise challenging area is even more complex.

Jaffe attorneys are experienced advisors and litigators on all matters involving data privacy and security. We counsel clients in all sectors on privacy, cybersecurity, and information management issues and assist clients in navigating the complex issues that affect their company’s data and the privacy of their customers and employees. We also work with non-profit organizations on privacy matters affecting their donors and volunteers.

We are experienced in managing and advising on data privacy and cybersecurity issues, data security breaches, mergers and acquisitions, joint ventures, marketing programs, consumer protection, outsourcing, compliance and regulatory matters, information management, and information sharing. We provide advice regarding privacy and data security issues related to HIPAA, GLB, and PCI regulations and advise clients regarding state, federal, and international laws and regulations and international laws and regulations, including the EU’s General Data Protection Regulation (“GDPR”), Canada’s Protection and Electronic Documents Act (“PIPEDA”) and the United Kingdom’s Data Protection Act of 2018, using our own resources and those of our international TAGLaw affiliates.

At Jaffe, we ensure that our clients are prepared for potential cybersecurity events, including the development of incident response plans, business continuity and disaster recovery plans, and data breach contingency response plans. We work hard to understand your business and how it operates in order to form the best protection strategy for you, your business, and your customers both for the short-term and into the future.
